Chapter 169 - Wrestling Board


169.01   ESTABLISHED; MEMBERS; CHAIRMAN.

There is established within the City government a commission, consisting of five members, to be known as the Springfield Wrestling Commission, the members of which shall be appointed by the Mayor with the advice and approval of the City Commission. Each of the members shall serve for a period of three years without compensation; provided, however, the initially appointed two members of the existing Commission shall be appointed as herein above provided, but the appointment of the three other members of the Commission shall be for a term ending August 31, 1974. The commission shall elect from its membership a Chairman, who shall serve for a term of one year. No person may serve as chairman for more than two consecutive terms.

169.02   POWERS; PERMIT FEE

The Wrestling Commission shall have full and complete jurisdiction, supervision and control over all wrestling shows, matches or exhibitions held, conducted or promoted within the City. without limitation upon the general powers herein conferred, the Commission shall have authority to perfect such organization and elect such officers from among its members as it may see fit; to formulate, and upon approval of the City Commission, issue and enforce such rules and regulations governing or relating to wrestling shows, matches or exhibitions as it may deem proper, including rules and regulations requiring approval by the Commission of participants, promoters, referees, purses, contracts, admission charges, complimentary admission, advertising, and places of exhibition, and including rules and regulations governing the conduct of contests; to issue permits for the holding, conduct or exhibition of any wrestling show or event; to impose penalties and forfeitures upon participants; to exact from exhibitors, promoters or contestants such security in the form of bonds, certified checks or otherwise as it shall see fit, guaranteeing the payment of obligations and compliance with the rules and regulations and requirements of the Commission, provided that in no event shall security for any show or exhibition be in an amount less than three thousand dollars ($3,000); to exact from any exhibitor or promoter a percentage, not more than two percent (2%) of the gross receipts from any wrestling show, match or exhibition; and to exact from any such exhibitor or promoter of any such wrestling show or exhibition a permit fee, which in no case shall exceed twenty-five dollars ($25.00) and which shall be in addition to such percentage hereinbefore referred to.

165.03   WAIVING OF PERMIT FEES OR PERCENTAGE OF RECEIPTS

When any wrestling show, match or exhibition is held, conducted or exhibited directly by any established and recognized charitable, religious, educational or welfare organization, the Wretling Commission may waive all or such portion of such permit fees or percentage of receipts as it determines to be proper.

165.04   DISPOSITION OF FUNDS

All funds coming into the possession of the Wrestling Commission, whether the same consist of permit fees, penalties, forfeitures, forfeited deposits, percentage of receipts or otherwise, after deduction therefrom of the reasonable and actual expenses incurred by it in the administration and enforcement of its duties and responsibilities, shall, as the same are received, be paid into the City Treasury to the credit of the Recreation Fund, or any successor fund designated for the same purpose, and shall be disbursed only for the purposes and in the manner in which all other moneys to the credit of such fund, or any successor fund thereto, are expended.

165.99   PENALTY; PERMIT REQUIRED.

Whoever, in being a person, firm, corporation, association or club, shall hold, conduct, promote or exhibit or cause to be held, conducted, promoted or exhibited, any wrestling show, match, card or event, or combination thereof, for a direct or indirect remuneration or consideration from spectators, whether in the form of an admission charge, membership, dues or otherwise, without having obtained a permit therefor from the Commission, or shall hold, conduct, promote or exhibit a wrestling show, match, ard or event in a manner contrary to the rules, regulations or requirements of the Commission with respect thereto, is guilty fo a misdemeanor of the third degree.
