AN ORDINANCE

Regulating the mode of fixing the grades of the streets, sidewalks, lanes, alleys and roads within the city of Springfield.

Sec. 1. The city council of Springfield ordain, That every grade hereafter agreed upon of any street, sidewalk, lane, alley or road within the boundaries of said city, shall be fixed on and established by a resolution of the city council, adopted after the subject of such grade shall have been referred to a committee, and a report made thereon accompanied by a profile made from an actual survey by the city engineer and surveyor.

Sec. 2. That any or all the grades heretofore established and recorded by order of the common coucil of the town of Springfield, or of the city council of Springfield, may hereafter be collectively or severally sanctioned and confirmed under the authority of this ordinance by resolution of the city council.

Sec. 3. That all established grades may be altered by resolution of the city council whenever they shall be of the opinion that the public good and welfare of this city require the same; provided always, that whenever any sidewalk, curbing or guttering has been paved or made by any owner or proprietor, on any street, lane or alley in this city aggreeable to the established grade made at the time such work shall have been done, and the city council shall afterwards alter the grade thereof, so that it becomes necessary to reconstruct such paving, curbing or guttering, the expenses of such reconstruction as aforesaid shall be paid out of the city treasury by order of said city council.

Sec. 4. It shall be the duty of the city engineer and surveyor to procure a suitable book at the expense of said city and therein to record all the grades of streets, lanes, roads, sidewalks and alleys within this city heretofore established by the common council of the town of Springfield or of the said city council, or that may hereafter be established under the provisions of this ordinance, and said book shall be used solely for the purpose of recording said grades, and to be handed over to his successor in office, at the expiration of his term of office.

Sec. 5. That all ordinances or parts of ordinances heretofore passed by the common council of the town of Springfield, or by the city council of Springfiled, contrary to the provisions of this ordinance, be, and the same are hereby repealed. This ordinance to take effect and be in force from and after the publication thereof.
